Agreement to Terms

By downloading, installing, or using Untwist (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

Description of Service

Untwist is a personal journaling and thought reframing application that uses Cognitive Behavioral Therapy (CBT) techniques to help users capture and reframe anxious thoughts. The App stores all data locally on your device.

Not Medical Advice

IMPORTANT: Untwist is NOT:

• A medical device
• A clinical tool
• A replacement for professional therapy or counseling
• A substitute for professional mental health treatment
• An emergency or crisis service

The App is intended for educational and personal development purposes only. The CBT techniques provided are general information and should not be considered medical or psychological advice.

User Responsibilities

By using Untwist, you agree to:

1. Use the App responsibly - The App is a tool to support your wellbeing, not replace professional care
2. Seek professional help when needed - If you’re struggling with mental health issues, please consult a qualified professional
3. Not rely solely on the App - Use Untwist as one part of your overall mental health toolkit
4. Keep your device secure - Your data is stored locally; protect your device with a passcode or biometrics
5. Be honest with yourself - The App works best when you engage authentically with the exercises

Intellectual Property

The App, including its design, features, content, and underlying code, is owned by John Pacheco and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Use the App’s content for commercial purposes
• Remove any copyright or proprietary notices

Privacy

Your privacy is fundamental to Untwist. Please review our Privacy Policy for details on how we handle (or rather, don’t handle) your data.

Key points:

• All your thoughts and data stay on your device
• We don’t collect personal information
• Optional feedback is the only data that leaves your device

Donations

Voluntary Support

Untwist is free to use, now and always. We accept voluntary donations via Ko-fi (ko-fi.com) to support development:

• No obligation - You are never required to donate
• No additional features - All app functionality is available to everyone, regardless of donation
• No special access - Donors receive the same app experience as non-donors
• Support development - Donations help cover hosting costs, Apple Developer fees, and development time

Donations are processed by Ko-fi and subject to:

No Refunds for Donations

Donations are voluntary contributions, not purchases:

• No refunds - Donations are final and non-refundable
• Not tax-deductible - We are not a registered charity; donations are gifts, not tax-deductible contributions
• Contact Ko-fi - For donation transaction issues, contact Ko-fi support, not Untwist

No Commitment to Updates

While we appreciate donations:

• We are not obligated to provide specific features, updates, or support
• We reserve the right to discontinue the app at any time
• We will never introduce paywalls, subscriptions, or feature-gating
• Your donation is a gift to support ongoing development, not a purchase contract

Disclaimers

No Warranty

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of content

Limitation of Liability

To the maximum extent permitted by law, John Pacheco shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Personal injury or emotional distress
• Any damages arising from your use of or inability to use the App

No Guarantee of Results

We make no guarantees that:

• The App will reduce your anxiety
• The CBT techniques will work for your specific situation
• The App will be error-free or uninterrupted
• Any particular outcome will result from using the App

Age Requirements

Untwist is designed for general audiences. While we don’t collect personal information, we recommend:

• Users under 13 should use the App with parental supervision
• If you’re a minor experiencing mental health difficulties, please talk to a trusted adult

Changes to Terms

We may update these Terms from time to time. We will:

• Update the “Last Updated” date
• Notify you of material changes through the App
• Post the updated Terms at this URL

Continued use of the App after changes constitutes acceptance of the new Terms.

Termination

You may stop using the App at any time by deleting it from your device. Upon deletion, all locally stored data will be permanently removed.

We reserve the right to discontinue the App at any time without notice.

Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Good faith negotiation
2. If unsuccessful, binding arbitration in Massachusetts

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and John Pacheco regarding your use of Untwist.
